I'd tell them, ok, well, my property with that house is worth X amount, buy it from me for that or maybe 2 or 3 lots of that size that adjoin, or they can pay the money to remove the brand new house. There's no way I'd let them off the hook after they sued me for the mistake they made.

A legal survey costs nothing in comparison to the land. The building of anything on her land was wrong. Asking for the house to be removed is her legal right and one that the builder and owner of the house should have been prosecuted.

I do not see the issue here it is built on the wrong lot it is the developers fault. They bear the cost of removal and building it again and any damages financially as well to the owner

It seems that attorneys for the builder are about as bright as the builders. What outcome were they hoping for when they sued the property owner? The obvious and less expensive solution would have been to come to a negotiated settlement. When you’re this wrong ya gotta take your lumps!

I'm not shocked that the outside developer began the action. I would expect they sought a declaratory judgment resolving who owned the property and an ancillary claim for unjust enrichment (which is where equity comes up). Without a sale other than the tax delinquency sale there is no title insurance to proceed against. There is still an amount of money that will settle this case.

They should give her 3 properties, side by side, and pay her attorney's fees One property for hers, and the other two for her time and trouble.

YES! Winner winner, chicken dinner. Barring settlement, the house will be removed. And why should she settle? For such schlock construction? Where they openly cut every available corner? Where squatters have defaced and destroyed the structure in unspeakably distasteful ways? No, thanks, the judge correctly assessed this as a case where the garbage house they barfed up onto her pristine, undeveloped land, actually made her property less valuable. So why did her taxes go up? Great question, I'd love to tell you. It's not because the land became more valuable with the house on it. Actually, the opposite. It has to do with the ancient concept of riparian water rights. Riparian water rights in Hawai'i are taken seriously. Land left to its natural state is very lightly taxed to encourage people not to develop. When land is developed, taxation is based (in part) on how much rain runoff the development 'steals' or prevents from returning to the water table. For a house and outbuildings, garage, shed, car port, etc., that's usually a series of straightforward area calculations - measured by the (exterior) sqft of the structures. Septic tanks / fields / catchment systems, too, have area formulae, because they also disturb the water table. One interesting method to lower your property tax burden in Hawai'i, is to maintain pea gravel and/or grass driveways and parking areas. They are taxed much less than concrete and asphalt. This is not because they make the property more valuable, it's because the former allow rainfall to re-enter the water table at the place it naturally lands, with a minimum of erosion, whereas the latter force water to find (and often overload) a different re-entry point to the watershed. Imagine the high points of the islands with delicate imaginary spokes emanating from the center, creating ethereal, imaginary pie slices of land, running from the mountaintops to the ocean. Each person on the island owns annually a tiny invisible slice of watershed from the mountains to the sea, this sliver represents the amount of water they will require each year. Now it doesn't do, to physically divvy up the watershed into these slender imaginary slices, so they're conceptually protected via taxation, which pays for the water systems. Each person with real property along those imaginary slices, has a duty to protect the watershed which runs along, beside, and through their land. Even the most ordinary of real property is non-fungible, but it's easy to see how island real property enjoys a particular scarcity that is difficult to overstate. Further, public policy favors land in its natural state over development. That is not necessarily public policy in every state, but it could be! The perennial joke is "buy land, it's the only thing they're not making any more of" a glib expression that seems to be true everywhere, except, humorously, volcanic island chains 🌋 😅 I do disagree with the judge, in that the property could almost certainly be restored. There is a vast wealth of redundant visual information that an experienced landscaping company can examine - pre-development photos, maps, surveys, drone footage, the neighboring undeveloped properties, satellite imagery such as Google earth - and readily supply mature flora, as well as ensure that water runoff is restored to its prior natural state (getting rid of the septic tank and field will not be trivial, but it will be straightforward). With the relative scarcity of real estate in Hawai'i, together with the fact that Hawaiʻi is one of the most thoroughly and topgraphically mapped and photographed places on the planet, and a survey was not undertaken? Inexcusable. From extensive daylight and nighttime drone footage of the coast lines and mountains, to the telephoto lens nature photographers, and indeed mapping and surveillance from space, in cooperation with sonar, in no small part due to the comparatively large military presence, her land can be restored. Certainly seems like there is a dividing line here between Reynolds and all the rest. Reynolds needs to be made whole because they are nothing to do with the errors or decisions made and it's their property. Everything else, the errors made, the expenditure of the construction and all that is for the other parties to work out - but in no way should Reynolds been caught up in that litigation to come.

As for any law enforcement demanding to unlock it, even with a warrant, I will not do so because one, I would be providing access to information that could incriminate myself somehow which is illegal, and, also access to I formation that has nothing to do with the warrant as I have , ots of personalmj formation there so no, they cannot have it since it is not on the warrant, so it is illegal for them to get into the phone. Besides that, I would use my right to ra\emain silence and that includes providing text in written form. If they attempt to unlock the phone multiple times, it gets wiped out automatically. Simple.
